Economic and Legal Basis of the Rule of Intellectual Property Law——For the 40^(th) Anniversary of China Intellectual Property Development

市场经济是私权制度的基础。知识产权作为私权,是市场经济的产物。反思单一财产制度导致中国经济封闭。改革开放建立市场经济,重建私权,构建民法制度体系。同时,改革开放解放被束缚的生产力,突破封闭,使中国进入全球市场体系。知识产权制度从无到有,应运而生。新时代,中国从"复制经济"转型为"创新经济"。应当进一步完善的市场经济,充分有效的保护私权。为中国的市场经济找到与世界市场经济的契合与平衡。解放思想,促进知识产权等私权制度的复兴。转变观念,承认"私"是第一性的客观存在,保障个体的生存空间符合科学发展观,进而为"私""私权"正名,把政策宣示上的"私权"正当性,转变为制度。《民法典》作为中国私权总章程,将为社会主义初级阶段的基本财产关系提供长治久安的法律保障。

Market economy is the foundation of private right system.Intellectual property right,as a private right,is the product of market economy.The single property system led to the isolation of China’s economy.Reform and opening-up policy has established market economy,reconstructed private rights,and constructed civil law system.At the same time,it has also liberated the shackled productivity,broken through the isolation,and enabled China to enter the global market system.The intellectual property system started from scratch.In the new era,China has transformed from a“copy economy”to an“innovation economy”.We should further improve the market economy and protect private rights effectively.China’s market economy shall fit in,and balance with,the world market economy.The mind should be emancipated and private rights such as intellectual property rights shall be revived.We shall change perceptions,admit that“private”is the first objective existence,protect the individual living space in line with the scientific development concept,justify for“private and private rights”,and legitimate“private rights”policy into the system.The civil code,as the general constitution of private rights in China,will provide a long-term legal guarantee for the basic property relations in the primary stage of socialism.
