Legalization of Library Undertakings: Environment, Model and Path

[目的/意义]在全面依法治国背景下,图书馆事业进入到法治化新的历史时期,需要对传统的模式做出变革,形成新的法治化模式,本文旨在通过研究和分析提出我国图书馆法制化建设的相关措施和建议。[方法/过程]从国家和图书馆事业多个层面分析图书馆事业的法治化环境,构建以"政府——图书馆——社会"为核心的图书馆事业法治化模式,然后就图书馆事业法治化道路提出相关措施与建议。[结果/结论]认为图书馆事业法治化道路建设要从以下六个方面着手:以《公共图书馆法》为基础,建立和健全图书馆事业法律体系;推进地方图书馆事业立法,提高立法质量;完善《公共图书馆法》的配套制度,适时修订《公共图书馆法》;推进高校图书馆立法,推进各类图书馆制度化设计;法治化的关键在于法律实施;加强法制教育,培育法治精神。

[Purpose/significance]Against the background of rule by law,the library undertaking has entered a new historical period of legalization,and it is necessary to change the traditional backward model and form a new model of legalization.This paper aims to advance relevant measures and suggestions for the legal construction of libraries in China through research and analysis.[Method/process]This paper analyzes the environment of rule of law in the library industry at the national and business levels,and constructs a model of legalization of the library industry with“government-library-society”as its core and puts forward the measures and suggestions related to the legalization of the library industry.[Result/conclusion]This paper holds that rule of law in the library industry can be realized through establishing and improving the legal system of the library undertakings based on the public library law,promoting local library legislation and improving the quality of legislation,improving the supporting system of the“Public Library Law”and amending the“Public Library Law”in due course,promoting the legislation of university libraries and the institutional design of various libraries,regarding implementation of the law as the key to the legalization,and finally strengthening legal education and cultivating the spirit of rule of law.
