侵犯个人健康生理信息犯罪中的“情节严重”类型数量阐释——基于侵犯公民个人信息罪司法解释反思

个人健康生理信息是个人信息的重要组成部分,但是侵犯公民个人信息罪的司法解释,对侵犯个人健康生理信息犯罪之"情节严重"的信息类型和数量的界定存在缺陷。应当从个人健康生理信息的隐私型分类和侵犯个人健康生理信息的量化两方面来阐释"情节严重"。对于与隐私权直接相关的个人健康生理信息需要严格保护,并采取不同于普通健康生理信息的"情节严重"标准。

Personal health physiological information is an important part of personal information,but the definition of the types and numbers of serious violation of personal health information crime has some defects in the judicial interpretation of the crime of violating citizens'personal physiological information.We should explain the seriousness of the case from the aspects of privacy classification of personal health physiological information and the quantification of the violation of personal health physiological information.Personal health physiological information directly related to the right to privacy needs to be strictly protected,and standards should be taken which are different from the ordinary serious standard of personal health physiological information.
