在《刑法》中增加对社区服刑人员“教育矫正(改造)”的规定

The Provision of Adding “Education Correction” for Community Inmates to Penal Law

社区服刑人员管理的一项重要内容是"教育矫正"。我国刑事立法因缺乏监禁教育矫正与非监禁教育矫正的衔接,缺乏对国际社区刑罚制度发展变化的关注,缺乏对罪犯在社区承担刑事责任发展变化的认识,导致《刑法》缺失"教育矫正"之规定。为弥补《刑法》缺失"教育矫正"的短板,可借鉴发达国家在刑法中注重的教育刑理念及其应用,依国情从立法角度增加"教育矫正"之规定:《刑法》中作出原则规定和《社区刑罚执行法》中作出具体规定。

An important part of the management of community inmates is“education correction”.The lack of connection between imprisonment and non-imprisonment education correction,the lack of attention to the development and change of international community penal system and the lack of awareness of the development and changes of criminal responsibility in the community lead to the absence of“education correction”provision in the criminal law.In order to make up for that weakness,the concept and application of education penalty in the criminal law of developed countries can be referred to,and the provisions of“education correction”can be added from the perspective of legislation according to the national conditions:the criminal law stipulates the principles and the community penal execution law makes specific provisions.
