摘要
从农地"三权分置"制度实施起,农地所有权、承包权、经营权的性质一直备受学界的关注,尤其是承包权与经营权权属之间的比较。物权性质的农地经营权不仅能保障农村土地的有序流转,而且可以真正发挥农地的财产性及保障性功能。从农地经营权性质、功能,以及中国土地政策发展来看,农地经营权登记与土地承包经营权登记并不冲突,应颁发不动产登记证书以及适用首次登记。
From the implementation of the “tripartite system” of agricultural land, the nature of farmland ownership, contracting rights and operating rights has always been concerned by the academic circles, especially the comparison between contracting rights and operating rights. The right to operate agricultural land of property rights not only guarantees the orderly circulation of rural land, but also can truly play the property and security functions of agricultural land. From the perspective of the nature and function of land operation rights and the development of Chinese land policy, the registration of farmland management rights does not conflict with the registration of land contractual operation rights. The registration certificate for real estate should be issued and the first registration should be applied.
