高价值专利识别方法有效性实证研究

选取已经市场检验的具代表性高价值专利实例,提取并归纳其主要特征,形成对高价值专利的一般性判据,给出高价值专利的判定方法。研究发现,高价值专利的识别可以从其内部特征和外部评价两方面进行,权利要求的长度及撰写烦冗度、说明书对发明构思的撰写清晰度、发明对人类生活的影响程度及影响人群数量和支付意愿等内部特征决定着是否属于高价值专利。而专利的被引频次、同族数量、被提起无效宣告请求次数等外部评价证据,也可以用来对高价值专利进行识别和判断,但是判断的时效性逊于专利内部特征。

The representative high-value patent examples that have been tested by the market are selected,the main features are extracted and summarized,the general criteria for high-value patents are formed,and the method for judging high-value patents is given.The study found that the identification of high-value patents can be carried out from both internal characteristics and external evaluations.Internal characteristics such as the length of the claims and the complexity of writing,the clarity of the description of the invention,the impact of the invention on human life,the number of people affected and willingness to pay determine whether the patent belongs to high-value patent.The external evaluation evidences such as the cited frequency of the patent,the number of the same family,and the number of requests for invalidation can also be used to identify and judge the high-value patent,but the timeliness of the judgment is inferior to the internal characteristics of the patent.
