浅析张耒的法律思想

An Analysis of Zhang Lei’s Legal Thought

张耒系苏门四学士之一,其学术思想受苏轼影响极为深刻。在张耒的政治主张与法律思想中,既包含了传统儒者崇尚礼治的鲜明态度,也蕴含了道家思想浸润下不扰生乐的道心思路。其中,张耒的法律思想融合了简意相和的立法观,修德尚仁的礼治观以及看重人治的悯刑观。他认为应当立法以意,注重礼祀,兼顾"人治",带有浓厚的悯刑特色。总之,张耒法律思想具有立法中的爱民重民,执法上的慎刑悯刑,以及反对因循的变革等特色,且始终带有苏门一脉传承的总体特质。但张耒并未摆脱传统儒生的思想藩篱,他的法律思想带有浓厚的时代特征。

Zhang Lei’s academic thought is deeply influenced by Su Shi.His political opinions and legal thought contains not only the Confucian but also the Taoist ideas.His legal thought integrates the legislative view of conciseness and harmony,the view of ruling with ritual,and the view of merciful punishment,which has the characteristics of loving the people and taking the people seriously,advocating careful and merciful punishment,and opposing conservative reform.However,Zhang Lei has not got rid of the ideological barriers to traditional Confucian scholars and his legal thought bears strong characteristics of the times.
