中国特色体育立法的基本经验与未来发展

Basic Experiences and Future Developments of Sports Legislation with Chinese Characteristics

改革开放40年来,我国体育立法形成了反映和体现党对体育工作的领导和党的体育政策法治化要求、以人民为中心的中国特色社会主义要求、创新精神和与时俱进的改革要求、体育事业发展和依法治体的法治要求、借鉴人类法治文明成果的体育国际化要求的中国特色社会主义体育立法基本经验。在中国特色社会主义进入新时代的我国发展新的历史方位背景下,总结改革开放40年来我国体育立法的基本经验,展望我国体育立法的未来发展,使我国体育立法从过去的适应和服务于体育改革向引领和推动体育改革的方向转变,从义务本位理念向权利本位理念转变。通过体育立法推动国家体育治理体系和体育治理能力现代化进程,推动"健康中国"国家战略在体育工作中的落实。尊重体育发展规律,改变体育管理体制机制,加快体育立法步伐,提高体育立法质量,增强体育立法的前瞻性,实现体育立法价值和功能的转变。落实"国家尊重和保障人权"的宪法精神,建构具有多样性与开放性的体育权利体系和体育权利救济体系,促进人的全面发展,迎接新时代中国体育改革深入发展和体育法治建设的进一步完善。

During 40-years reform and opening in China,sports legislation in China has developed basic experiences such as reflecting and embodying the Party's leadership in sports working and the Party's requirement of sports policies to be legalized,the requirement of socialism with Chinese characteristics centered on the people,the innovative spirit and the reform requirement of keeping pace with the times,the development of sports undertakings and the requirement of rule of law for sports legalization,and sports legislation of socialism with Chinese characteristics of the requirements of sports internationalization with reference to human law civilization.Under the new historical background of developments that socialism with Chinese characteristics has entered a new era,we should summarize the basic experience of sports legislation in China in the past 40-years reform and opening,look forward to the future development of sports legislation in China,change our sports legislation from adapting to and serving sports reform in the past to leading and promoting sports reform,and from the concept of duty standard to the concept of right standard.The modernization of national sports governance system,sports governance capacity,and the implementation of the national strategy of "healthy China"in sports will be all promoted through sports legislation.We should respect the law of sports development,change the mechanism of sports management system,accelerate the pace of sports legislation,improve the quality of sports legislation,enhance the forward--looking of sports legislation,and realize the transformation of sports legislation value and function.We should also implement the constitutional spirit of "respect and guarantee of human rights by the State",construct a sports rights system and a sports rights relief system with diversity and openness,promote the all-round development of human beings,and welcome further improvements of China's sports reform development and legal construction in the new era.
