监所监督权的权力设置结构探析

开展监所监督工作,是检察机关的职权之一,但此项权力也要受到法律的约束,防止监所监督权的滥用,因此检察机关必须明确把握监所监督权性质的定位。但立法中对监所监督权的性质定位并未有明确规定,所以一直以来颇有争议。而对于监所监督权在检察机关的权力体系中处于什么法律地位,与其他权力又是什么关系,这些问题的厘清都有助于对监所监督权的进一步研究。只有通过深刻的反思,从全方位角度将其与监所监督、法律监督权、检察权以及刑罚执行监督权进行比较,才能更加深刻地理解其性质,才能让监所监督工作更科学更全面的开展。

It is one of the functions and powers of the procuratorial organs to carry out the supervision work of the procuratorial organs.However,this power is also subject to the law.To prevent the abuse of the supervisory authority,the procuratorial organs must clearly understand the positioning of the nature of the supervisory authority.However,there is no clear regulation on the nature of the supervision of the supervisory authority in the legislation,so it has been controversial.Such problems will help to further study the supervisory power of the prison as clarifying the legal status of the supervisory power of the prison in the power system of the procuratorial organs and the relationship with other powers.Only through deep reflection and comparison with supervision of prison,legal supervision,procuratorial power and supervision of penalty execution from an all-round perspective,can we have a deeper understanding of its nature and make supervision work of prison more scientific and comprehensive.
