Examining the Disciplinary Measures of “Prohibiting Children from Attending High-paying Schools”

在"基本解决执行难"背景之下,当前民事执行实践之中对失信被执行人惩戒性措施适用较为广泛。当前执行实践中禁止"子女就读高收费私立学校"惩戒性措施适用中存在着与执行原理相悖的做法。为合理适用禁止"子女就读高收费私立学校"这一惩戒性措施,应当在区别该惩戒性措施与其他惩戒性措施的基础上,审慎适用该惩戒性措施。在该措施的适用时,应当明确"高收费"等前置标准,通过双重识别模式,运用个案工作方法与比例原则,采取主动地禁止"子女就读高收费私立学校"惩戒性措施。我国当前的执行实践之中还应该注意惩戒性措施适用的合理性与该当性、惩戒性措施的救济保障以及协助执行范围等问题,以期更好的解决执行实践中所涉问题。

In the current execution practice, there is a practice contrary to the execution principle in the application of disciplinary measures prohibiting “taking high-fee private schools”. In order to properly apply the disciplinary measures of prohibiting “attending high-fee private schools”, the disciplinary measures should be prudently applied on the basis of discriminating between the disciplinary measures and other disciplinary measures. In the application of this measure, we should clarify the pre-standard of “high fee”, adopt the disciplinary measures to prohibit “high fee private schools” actively through the dual identification model, the use of case methods and the principle of proportionality. In the current execution practice of our country, we should also pay attention to the rationality and propriety of the application of disciplinary measures, the relief guarantee of disciplinary measures and the scope of assistance in execution, so as to better solve the problems involved in the execution practice.
