摘要
物权变动中常常关涉是否为善意取得的问题,即第三人是否出于善意,善意的存在与否成为第三人权利能否实现的关键。我国《物权法》第一百零六条中规定了不动产善意取得制度的构成要件,但对于什么是善意第三人的"善意",并无进一步的规定,在实务中善意第三人的界定容易产生疑义,对于物权变动中善意第三人构成要件中的"善意"的界定,直接涉及当事人权益能否得以实现。
The change of property right often involves whether the acquisition in good faith,that is,whether the third party is out of good faith,the existence of goodwill is the key to the realization of the rights of the third party. Article 106 of the "Property Law" of China stipulates the constitutive elements of the system of bona fide acquisition of real estate,but there is no further stipulation on what is the "bona fide" of a bona fide third party,in practice,the definition of the third party in good faith is still easy to have doubts,the definition of "goodwill" in the constitution of bona fide third party in the real right change directly relates to whether the rights and interests of parties can be realized.
