摘要
以广州市加强大城管体制建设为契机,通过文献法和访谈法,从组织管理体制、法规制度建设、联合执法机制三方面剖析广州市水域市容环境卫生联合执法现状、问题及成因,以大部制与集权分权理论为指导,建议:(1)在纵向管理体制和横向联合执法机制两方面健全联合执法体制;(2)从法规制度建设、整合修订、标准统一三方面完善联合执法法律法规体系;(3)落实问责制度、强化责任区监管、服务外包、建立更广泛的社会参与机制。
Taking Guangzhou as an example to strengthen the construction of large city management system,this paper use the literature method and interview method to sort out the status quo of the joint law enforcement of city appearance and environmental sanitation in water area of Guangzhou.Then it analyzes the existing problems and causes from the aspects of organization and management system,construction of laws and regulations,and joint enforcement mechanism.Guided by the theory of centralized system and centralized power,it is recommended to:(a)improve the joint law enforcement system in both the vertical management system and the horizontal joint enforcement system;(b)improve the law system from the aspect of construction,integration and revision,as well as unified standard;(c)implement the accountability system,strengthen the supervision of the responsible area,adopt service outsourcing and establish broader social participation.
