Recent Development and Frontier Issues in International Law

世界正经历巨大变局。国际法的发展呈现五大特征:全球治理体系和国际秩序变革加速推进,制度性权力和未来秩序主导权之争成为大国博弈的主战场;国际竞争从传统陆地疆域向包括海洋、极地、外空、网络在内的新疆域拓展的态势愈发明显,海洋领域规则制定和实施持续走深走实;网络空间战略地位不断上升,在国际议程中的位置加速前移;气候变化谈判进入转折期,各方加紧谋划未来全球环境治理体制;国际法日益成为对外斗争的重要抓手。在此大背景下,人类命运共同体与国际法、"一带一路"法治保障、《禁止核武器条约》与全面核裁军进程、国际司法机构与国际法的解释与适用、条约履约机构和缔约国大会扩权动向、国际法院"查戈斯群岛咨询意见案"、朝鲜半岛局势相关法律问题、美英法对叙利亚动武的合法性问题、全球海洋治理及"南海仲裁案"后续法律问题、构建中国特色国际法学体系等十大前沿法律问题值得学界关注和研究。国际法学人应怀着对法律的敬重,以自己的专长为国家外交和世界和平事业做贡献,努力开创国际法学研究的新局面。

Mankind is in an era of major development as well as profound transformation and change, which has a very strong influence on the recent development of international law. Five emerging tendencies toward international law has been identified and analyzed in respect to the global governance, international regulation of seas, polar regions, outer space, cyber space and the climate change. The rule of international law has been strengthened consistently. For the purpose of legal research, attention is drawn to the certain frontier legal issues such as legal implications of the concept of building of a community of shared future for mankind;legal guarantee for “the Belt and Road” initiative, due process of a total ban on nuclear weapon, the role played by international courts and treaty-bodies in terms of their jurisdiction. The further attention is paid to legal issues relating to the advisory opinion of the ICJ on the Chagos Case, new situation in Korean Peninsula, and so-called “humanitarian intervention”. There is a growing call for a fairer and more equitable international order.Legal scholars are encouraged to provide suitable legal solutions to meet the challenges faced by the mankind.
