摘要 本文以清华大学深圳研究生院"知识产权法律及实务"课程为例,对知识产权法案例教学展开实践探索和模式思考。在对"个案教学法"、"法律诊所教育"和"实例研习"三种经典案例教学模式综合应用的基础上,以美国教育心理学家奥苏伯尔的学习理论为指导,总结出一套以提升法律应用能力为导向的"参与式训练+专家指导"的案例教学模式。同时,在案例研究中,案例选择应遵循关联性原则,案例分析应遵循模块化原则。 This paper takes the "Intellectual Property Law and Practice", course of Graduate School at Shenzhen of Tsinghua University, as an example to explore the practice exploration and mode design of the case teaching of intellectual property law. Based on the comprehensive application of the three classic case teaching modes of "case method","clinical legal education" and "übung", guided by American educational psychologist Ausubel's learning theory, the author proposes a case teaching mode of "participatory training + expert guidance", which is oriented to improve students' ability to use the law. At the same time, during the case study, case selection should follow the principle of relevance, and case analysis should follow the principle of modularity.
