Misconception and Correction of Judicial Cognizance for Basic Characteristics of Eradicating Social Evils

2011年《刑法修正案(八)》规定,黑社会性质组织犯罪的成立应同时具备组织结构特征、经济特征、行为特征、非法控制四个特征。但司法机关在具体认定过程中,存在着定性不统一的尴尬。结合近几年扫黑除恶的具体实践,将四个基本特征视为一个整体,采取文义解释学的方法,分析其确切内涵,是当前扫黑除恶斗争一个不可或缺的前提。

In 2011,The Amendment to the Criminal Law(8)stipulates that the establishment of crimes committed by underworld organizations should provide with the four characteristics of organizational structure,economy,behavior and illegal control.However,in the specific process of identification process,to their embarrassment the judicial organs have non-uniform standard for determining the nature.Therefore,in combination with the concrete practice of eradicating social evils in recent years,regarding the four basic characteristics as a whole and adopting the method of textual hermeneutics to analyze their exact connotation is an indispensable prerequisite for the current struggle against social evils.
