论党内法规与国家法律之衔接协调机制

On the Cohesion and Coordination Mechanism Between the Party Regulation and Law

党内法规与国家法律的衔接协调机制仍然存在一些问题:党内法规制定主体和国家立法部门之间缺少工作协调机制;党内法规"法律性"薄弱,表现为党内法规条款结构的规范性不足、程序性党内法规和审查性党内法规缺失、实施机制不健全等;党内法规的实施过程存在选择性、表面化、降格型和碎片化等乱象。建立健全党内法规与国家法律的衔接协调机制,须正确认识党内法规制度的体系化,树立二者衔接协调的基本原则,关注党内法规的"先行先试"并研究其向国家法律转化的具体路径和保障机制。

It still exists some problems in the cohesion and coordination mechanism between the Party Regulation and Law. There is a lack of work coordination mechanism between the rule-making agency of Party Regulation and the legislative department. The legal characteristics o f the Party Regulation is not obvious, prominently reflected in the lack of normative structure, procedural norm, review norm, and the imperfect implementation mechanism. Selective, superficial, degraded, fragmented and other chaotic phenomena appear in the implementation of the Party Regulation. To establish and perfect the cohesion and coordination mechanism between them, we must correctly understand the systematization of the Party Regulation, establish the basic principles of cohesion and coordination of the two, pay attention to the take-the-lead role of the Party Regulation, and research on the specific path and safeguard mechanism for the transformation to law.
