The Study on the Case Filing Procedure Standardization of Supervisory Organ

伴随国家监察体制的改革以及《中华人民共和国监察法》的出台,职务违法犯罪案件调查程序在新时期呈现出全新的制度特征。监察机关立案程序有别于传统刑事诉讼中的立案程序,新时期监察机关立案调查阶段的工作直接影响着职务犯罪案件移送检察机关审查起诉、进入诉讼程序阶段。探究监察机关立案程序规范化运行是监察体制改革的重点内容,也是监察调查衔接刑事诉讼程序的关键。

With the reform of the nation supervisory system and the promulgation of the Law of Nation Supervision ,the investigation procedure of the crime by taking advantage of duty has a new system characteristic in this new era. The case filing procedure of supervisory organ is different form the traditional filing procedure in crimiiial lawsuit,the stage of preliminary investigation directly affect that the crime by taking advantage of duty transfer to supervisory organ to review and prosecution,and into the stage of judicial proceedings.Exploring the normalized running of the supervisory organs case filing procedure is the major content of the supervisory system reform,and is also the key to link up the supervision and crime procedure.
