从保证方式看取保候审制度的完善

取保候审是我国法定的强制措施,保证方式是取保候审制度的核心内容。我国的取保候审制度具有存在的必要性,保证方式也具有继续发挥作用的空间,取保候审保证方式在刑事诉讼中体现出重要价值。我国保证方式存在很多的问题,如保证方式不全面、保证金额规定不明确等。学界也对取保候审的保证方式存在争议,但是我国保证金保证和保证人保证还是需要保留。英国、美国等国家和地区保释制度的规定比较全面,也产生了良好的效果,对我国具有借鉴价值,我国应当在考量中国国情的前提下借鉴域外制度。我国保证方式的进路应当是建立财产保、人保与具结保证相结合的保证体系,在这一体系下,我国取保候审制度才能真正的发挥作用。

Guarantee pending trial is a legal compulsory measure in our country and guaranteeing method is the core content of guaranteed pending trial system. China′s guaranteed pending trial system has the necessity of existence, the way of guaranteeing also needs to play its role, the way of guaranteeing pending trial on bail embodies important value in criminal proceedings. There are many problems in the way of guaranty in our country, such as the incomplete way of guaranty, the unclear stipulation of the amount of guaranty and so on. Scholars also have disputes on the guarantees of obtaining bail pending trial, but in China, the guarantees of deposit and guarantor still need to be retained. In britain, the United States and other countries and regions, bail system is more comprehensive, but also produced good results, with reference value to China, China should take into account China′s national conditions under the premise of drawing lessons from the extraterritorial system. The way of guaranteeing in China should be to establish a guarantee system which combines property, personal and bonded guarantees. Only under this system can our guaranteed pending trial system play a real role.
