Amendment of Markush Claim in Patent Invalidation Procedure

无效程序中能否进行马库什要素的删除式修改在实务界和理论界存在争议。对马库什权利要求持整体技术方案论的一方认为删除式方式不属于《专利审查指南》规定的修改方式,不能被接受,而持并列技术方案论的一方认为删除式修改符合《专利法实施细则》的规定,应当被允许。最高人民法院在(2016)最高法行再第41号判决中首先论述了马库什权利要求的性质,并在充分考虑化学领域发明创造的特殊性及个案因素的基础上,对马库什要素的删除式修改采取了附条件接受的态度。本文研究了最高院裁判结果的价值指引,分析了判决中指出的"不能因为修改而产生新性能和作用的一类或单个化合物"审查标准。

It is controversial in practical and theoretical circles whether the Markush elements of a Markush claim could be deleted when amendment is made to the Markush claim in patent invalidation procedure.The party with a viewpoint of overall technical solution holds that the deletion of Markush elements does not comply with the provisions of the Guidelines for Patent Examination and shall be banned.While the other party claims that such an amendment comply with the provisions of the Implementing Regulation of the Patent Law and shall be allowed.In the judgment of case of(2016)Zui Gao Fa Xing Zai No.41,the Supreme People's Court fi rstly clarifi ed the nature of Markush claim.Taking full account of the particularity of invention-creations in the fi eld of chemistry and on the case-by-case basis,the Supreme People's Court adopted a conditional acceptance of the deletion of Markush elements in patent invalidation procedure.The value orientation of this judgment by the Supreme People's Court,as well as the examination standard for the amendment of Markush claim was studied.
