Study on Revocation Examination Standard of the Basic Definition of IC Layout Design: Starting from a Revocation Examination Case of IC Layout Design Right

本文以国内第一件涉及集成电路布图设计基本定义的撤销案件为线索,从案件争议的焦点出发,探讨了基本定义中"以执行某种电子功能"的立法目的、使用背景、判断的主体和客体、适用条件以及其与独创性条款之间的关系,最后介绍了该撤销案件的主要审查思路,以期为相关法律条款的适用提供参考。

Based on the first revocation case involving the basic definition of IC layout design in China,starting from the focus of the dispute in the said case,this paper discusses several aspect of"to perform some electronic function"in the basic definition,which includes the legislative purpose,background,subject and object of judgment,applicable conditions and the relationship between the clauses of basic defi nition and the originality.Finally,it introduces the main examination ideas of the revocation case,with an expectation to provide reference for the application of relevant legal provisions.
