重复授权问题思考

Thinking of the Problem About Double Patenting

基于审查实践中遇到的问题,对禁止重复授权原则、先申请原则以及现行专利法及实施细则相关条款的应用进行分析,针对同一申请人就同样的发明创造先后提出两份专利申请、且在先申请属于申请在先、公开在后的情况如何处理在先申请的问题,提出了个人看法。

For the problem found in the examining practice,analyzing the application of the principle of non-double-patenting,the principle of first-to-file,relevant clauses in the existing patent law and implementing regulations thereof,giving a point of view about how to deal with the earlier application in the case of the same applicant has fi led successively two patent application for an identical inventioncreation,wherein the earlier application is fi led prior to the fi ling date of the latter and disclosed after said fi ling date.
