通信领域“转用发明”案件的创造性评判

Determination of Inventive Step of "Invention by Diversion" Cases in the Field of Communication

"转用发明"是通信领域专利审查中常见的案件类型,基于不同的检索结果,可采用不同的创造性评判方式。本文从三种常见情形下的实际案件出发,对比分析了检索结果、争议焦点、评判重点等方面的异同,归纳了该类案件的创造性评判策略,以助于通信领域中该类案件的检索与审查。

"Invention by diversion"is a common type of case in patent examination in the field of communication.Different determination methods of inventive step can be adopted based on different search results.Based on actual cases in three common situations,this paper compares and analyzes the similarities and differences from the aspects of search results,controversy focus and determination focus,and summarizes the determination strategies of inventive step of such cases to contribute to the search and examination of such cases in the fi eld of communication.
