论我国电信诈骗立案管辖的困境及应对策略

Research on the Practical Problems and Countermeasures of the Jurisdiction of Telecom Fraud in China

电信诈骗案件中的立案管辖问题是指跨省跨市电信诈骗案件中存在的各地相关公安机关的管辖冲突问题。各界学者对电信诈骗管辖权的问题早已关注,但大多从跨国跨区跨法域和立法的角度来研究,对电信诈骗立案管辖的现实困境研究较少。实际操作中存在的管辖冲突已成为公安一线急需解决的问题。应当从立案管辖中实际遇到的问题出发,分析当前管辖冲突的现实困境并提出应对策略,以切实提高电信诈骗案件的立案效率。

The issue of jurisdiction on file in Telecom fraud cases refers to the jurisdictional conflicts of the relevant public security organs in different places in Telecom fraud cases across provinces and cities.Scholars from all walks of life have paid close attention to the jurisdiction of telecommunication fraud for a long time,but most of them study it from the perspective of transnational,trans-regional and trans-jurisdiction and legislation.The conflict of jurisdiction in practical operation has become an urgent problem in the front-line of public security.Starting from the actual problems encountered in the filing jurisdiction,this paper analyzes the realistic dilemma of the current jurisdictional conflicts and puts forward countermeasures to effectively improve the efficiency of the filing of telecommunication fraud cases.
