摘要 我国劳动法将劳动关系用工主体规定为"用人单位"而非雇主,并规定判断劳动关系是否成立的首要标准是主体资格,这与其他国家或地区是不同的。然而我国劳动法仅列举了6种"用人单位",并未明确"用人单位"主体资格的构成要件,导致"用人单位"的范围局限于6种类型,不可避免地产生了若干法律漏洞,更无法涵盖新形势下的新情况,因此,完善"用人单位"主体资格的构成要件具有重要的意义。 The labor law of our country defined Employment subject as employing units and workers, not employers. The primary criterion for judging whether the labor relationship is established is the subject qualification, that is different from other countries or regions. However, China's labor law only enumerates 6 kinds of "employing units", it does not stipulate the constituent elements of the qualification of the "employing unit"and the scope of the"employing unit"is limited to 6 types. So anumber of legal loopholes are unavoidable, it is unable to solve new problems under the new situation. Therefore, it is of great significance to improve the constituent elements of the subject qualification of the"employing units".
