摘要
本文分析了北京开展人才立法的必要性和可行性。认为北京人才立法对象"人才"的概念内涵与外延已基本清晰,立法调整的范围已基本明确,且促进人才发展的根本性问题亟须通过立法调整。北京人才立法要解决的主要问题是人才工作领域政策失灵、政府与人才失信并存等,要处理的主要关系涵括效率与公平、下位法与上位法、立法与规划战略、地方特色与区域经济一体化发展等。
This paper analyzes the necessity and feasibility of developing talents legislation in Beijing. It is believed that the concept and extension of "talent" in Beijing’s talent legislation is basically clear, and the scope of the legislative adjustment has been identified. The fundamental problem of promoting the development of talent needs to be adjusted by legislation. The main problems to be solved in Beijing’s talent legislation are the malfunction of policies in the field of talent and the coexistence of discredit of government and talents. The major relationships to be dealt with include efficiency and fairness, the lower law and the upper law, the legislation and planning strategy, local characteristics and the economic integrated development.
