摘要
强化对行政权的监督与制约是法治国家的必然选择,这对作为公共利益代表的检察机关监督行政违法行为的实践与发展提出了新命题。在公益诉讼制度框架下开展行政违法行为检察监督不仅切实可行,还是重塑行政检察监督职能的最佳选择。检察机关和监察机关对行政违法行为实施监督各有侧重、并不冲突,域外法治国家已普遍形成类似做法。当前,需要在公益诉讼制度框架下解决行政违法行为检察监督的基本原则、范围与内容、方式与程序及保障机制等问题,从而促进行政违法行为检察监督的科学发展。
It is an inevitable choice for a country ruled by law to strengthen the supervision and restriction of administrative power,which puts forward a new proposition for the procuratorial organ,which is the representative of public interest,to supervise the practice and development of administrative illegal acts.Under the framework of public interest litigation system,it is not only feasible to carry out procuratorial supervision of administrative illegal acts but also the best choice to reshape the functions of administrative procuratorial supervision.Procuratorial organs and supervisory organs have different emphasis on the supervision of administrative illegal acts and do not conflict with each other.Similar practices have been generally formed in countries governed by law outside China.At present,it’s necessary to tackle the issues of basic principles,scope and content,methods and procedures and safeguard mechanism of the procuratorial work of administrative illegal acts under the framework of public interest litigation system so as to promote the scientific development of the procuratorial work of administrative illegal acts.
