中国与中亚五国的专利制度异同点研究

Research on Similarities and Differences of Patent Law System Between China and Five Central Asian Countries

中国技术突飞猛进,中国专利主体在为中国专利申请量授权量作出贡献的同时,利用世界知识产权组织提供的国际专利申请途径扩大专利族的申请数量,借"一带一路"倡议的东风实施专利技术"走出去"布局并帮助促进中亚五国的技术进步和经济发展。中亚五国资源能源丰富对中国有很大的吸引力,作为紧邻,中国与中亚五国贸易合作和技术合作更是便捷互补。本文在研究中亚五国市场需求、中国技术存量及中资企业在中亚五国专利技术布局的基础上,研究中国与中亚五国在国际专利法律制度、国内专利法律制度特别是专利申请主体、保护客体、审查程序、权利期限等规定的异同点。

With Chinese technology advancing rapidly, Chinese patentee, while making a contribution to the volume of Chinese patent filing, has enlarged the application number of patent family by the means of international patent applications in accordance with law provided by the World Intellectual Property Organization, and patented technology has gone abroad through“ the Belt and Road” initiative to help promote technological progress and economic development in five Central Asian countries. The five countries in Central Asia bound in resources and energy, which are clearly attractive to China, and cooperation in trade and technique between China and the five Central Asian countries are both convenient and beneficial for each other. On the basis of studying market demand of the five Central Asian countries, stock of Chinese technologies and distribution of Chinese enterprises' patent technology in five Central Asian countries, this paper studies the similarities and differences between China and five Central Asian countries in the international patent law system, the domestic patent law system, particularly in the subject of patent application, protection object, examination and approval procedure and right term.
