“净身出户”协议的效力探讨及裁判策略

On the Validity of the Agreement of "Clearing out with Nothing" and Its Judgment Strategy

"净身出户"协议是夫妻双方基于物权对夫妻共同财产分割的约定。"净身出户"协议不是一般民事协议,而是离婚协议的一种类型,不具有单独可诉性。司法裁判时,应当依据婚姻法、民法、合同法、侵权法的相关规定综合判断其效力是否存在,应当作为离婚诉讼附带的财产分割争议一并审理,坚持个案裁判结果公平,尤其注重保护婚姻弱势一方和平衡夫妻双方的正当利益。

The agreement of"clearing out with nothing"is a joint agreement on property rights between husband and wife.Instead of a general civil agreement,the agreement of"clearing out with nothing"is a kind of divorce agreement that is not separately actionable.In judicial adjudication,we should comprehensively judge whether this kind of agreement is valid or not according to the relevant provisions of marriage law,civil law,contract law and tort law,and try it as an incidental property division dispute in divorce proceedings,guaranteeing the fair result of the case adjudication,with particular emphasis on protecting the weak party in marriage and balancing the legitimate interests of both husband and wife.
