On Several Legal Problems of the Construction of Social Credit System in China

我国的社会信用体系建设刚刚起步,相关的法律体系还不完善,还有一些重要的法律问题需要解决,如征信机构的法律问题、征信行为的法律问题和征信信息的法律问题等。为了提高征信信用的公信力,法律法规有必要对征信机构的性质和地位进行规制。对于征信信息的法律问题,国家应当打破信息垄断,主动构建诚信社会,同时采用国家强制标准来设定相关技术性措施以保障社会信用信息的安全。

The construction of social credit system in China has just started,and the related legal system is not perfect.there are some important legal problems in the social credit system that need to be solved.For example,the legal issues of credit agencies,the legal issues of credit seeking behavior,and the legal issues of credit information,etc.In order to improve the credibility of credit collection,it is necessary for laws and regulations to regulate the nature and status of credit collection institutions;As for the legal problem of credit information,the state should break the monopoly of information and construct a society of good faith on its own initiative.At the same time,the state should set up relevant technical measures to protect the security of social credit information.
