农村社区矫正问题分析及其完善——基于四川省绵阳市Z县的实证分析

The Improvement of Community Correction in Rural Area: An Empirical Analysis from Z County in Mianyang, Sichuan Province

无论是刑罚"人道""轻缓""文明""保障罪犯人权"等理念的发展,还是强化社区服刑人员矫治效果都对社区服刑人员的权利保护提出了新的要求.自2003年我国开展社区矫正试点工作以来,关于社区矫正制度的研究主要集中于城市社区,且实证研究较少,从权利保障视角结合农村地区社区矫正实证研究就更少了.由于城乡二元化差异,农村地区社区矫正开展不能照搬城市社区矫正经验,通过对绵阳市Z县基层司法所的实证调研,发现四川省农村社区矫正存在无法"应需而矫"、矫正效果差、单一依赖政府推动、社区发展乏力、传统思维僵化、重"管教"轻"赋能"等问题,针对这些问题提出了解决对策,期许解决四川省农村地区社区矫正实践中面临的困境.

A new reqirement for the protection of the criminal's right in community is raised by both such ideas as "humanitarianism ","mitigation","civilization" and "ciminal's right protection" and the intensification of community correction.Since 2003,the study of cummunity correction has focused on the urban area,and the empirical study is fewer and especially the study of attention to the rural area from the perspective of the right protection is fewest.Because of the difference betwee the rural and urban area,the study of the former can not copy the latter.The investigation of Z County in Mianyang,Sichuan province shows such problems as "correction without satisfication of needs",poor effective,sole dependence on government,feebleness of development in community,rigidity of thinking,more attention to "discipling" than to "engergization".For that,some measures are put forward in order to deal with the difficulties.
