我国性侵幼女犯罪的刑事政策研究

A Study on the Criminal Policy of Sexual Assault on Young Girls in China

我国目前针对性侵幼女犯罪的刑事政策主要是狭义说指导下的刑事政策。面对日趋严重的性侵幼女犯罪现象,研究和调整性侵幼女犯罪的刑事政策显得尤为重要。性侵幼女犯罪的刑事政策与中国基本刑事政策之间属于具体刑事政策与基本刑事政策的关系,对前者的研究离不开对后者的仔细梳理。严厉程度逐渐加大的狭义说指导下性侵幼女犯罪的刑事政策,并没能遏制性侵幼女案件的发展态势,治理性侵幼女犯罪应当动用社会整体力量即采用广义的刑事政策,应当将学校、社区、家庭等纳入到防范和治理性侵幼女犯罪的队伍中来。

The current criminal policy of sexual assault against young girls in China is mainly a criminal policy in a narrow sense.In the face of the increasingly serious sexual assault of young girls,it is particularly important to study and adjust the criminal policy of sexually assaulting young girls.The criminal policy of sexual assault on young girls and the basic criminal policy of China belong to the relationship between specific criminal policies and basic criminal policies.The study of the former is inseparable from the careful analysis of the latter.The criminal policy of sexually assaulting young girls under the guidance of a stricter narrow sense theory has not been able to curb the development of sexual assault cases.The crime of invading young girls should use the overall force of society to adopt a broad criminal policy.Schools,communities,and families should be included in the team to prevent and manage the crime of invading young girls.
