摘要
司法官遴选委员会能在较为宽松的时间限度内开展遴选工作,有与候选人面对面交流的机会,其遴选出来的候选人能获得同级人大认可并被任命,此乃司法官遴选委员会具有权威性的基本要求。然而,在现实的司法官遴选委员会运行过程中,时间上的充足性、过程上的亲历性和结果上的权威性,均未得到严格执行。从有关"两高"及各地司法官遴选委员会遴选过程的报道上看,司法官遴选委员会的遴选过程更多流于形式,未能发挥好预设的专业把关功能。强化司法官遴选委员会在司法官遴选过程中的话语权,保障司法官遴选委员会真正主导司法官的遴选,乃司法官员额制改革取得实质进步之关键。
It is the basic requirement for the Judicial Officer Selection Committee(JOSC) s authoritativeness that the JOSC can carry out the selection work within a relatively relaxed time limit and has the opportunity to communicate face to face with the candidates and the candidates selected by the JOSC can be approved and appointed by the people s congress of the same level. However, the adequacy of time, personally experienced of the process and the authority of the results have not been strictly enforced during the actual operation of the JOSC. From the reports on the selection process of the JOSC of the superior court and the superior procuratorate and other localities, the selection process of the JOSC has gone through more formalities and failed to play the presupposed function of professional gatekeeper. Strengthening the right of discourse of the JOSC in the process of selecting judicial officers and ensuring that the JOSC can be able to really lead the selection of judicial officers are the key to the substantial progress of the reform of quota system.
