论刑事诉讼中未成年人社会调查制度的完善

Research of minor social investigation system in the criminal procedure

2012年新《刑事诉讼法》专门设专章规定"未成年人刑事诉讼特别程序",把未成年人犯罪问题再次引入国家的视野。未成年社会调查制度的首次确立,成为我国刑事诉讼立法的一大创新之举。但是这一制度的规定却比较笼统空洞,在实践适用中仍存在很多问题。故欲通过对未成年人社会调查制度的概念和特征的分析,进一步研究我国当前未成年人社会调查制度的现状及存在问题,从而提出完善未成年人社会调查制度的相关措施,如明确社会调查的主体,完善社会调查报告的内容以及改良社会调查的调查程序等,以期更好地减少和预防未成年人犯罪,维护未成年人的合法权益。

Criminal Procedure Law,which was enacted in 2012,increased a chapter named the“proceedings in juvenile criminal cases”,and again lead the minor crime problem in national vision.The first establishment of the system of minor social investigation also shows that the nation attaches importance to minors.But the rule of this system is more general and empty,and there are still many problems in practice.So this passage want to analyses the concept and characteristics of the minor social investigation system,and further study the current status and problems,such as confirming the main subject of social investigation,perfecting social investigation report and improving the procedure of social investigation etc.in order to reduce and prevent the minor crime,safeguard the legitimate rights and interests of minors.
