Administrative Trust Protection in Urban-Rural Planning

对于城乡规划中的信赖保护,最重要的任务在于寻找公共利益和个人信赖利益的平衡。规划性行政行为在制定和实施的过程中充满了不确定性,主客观因素的纷杂往往会带来规划的变动,在这个过程中,如何保护公民个人信赖利益就显得尤为重要。文章从实体保护、程序保护、司法救济等角度探讨了城乡规划中的个人信赖利益保护问题。

In urban and rural planning of trust protection,the most imperative task is to look for the balance of public interests and personal trust. The planning administrative behavior in the process of formulating and implementing is full of uncertainty. Numerous subjective and objective factor can result in the change of the original plan. During this process,it is of importance to protect the interests of citizens’ personal trust interests. In this paper,the writer primarily analyzed how to realize the personal trust benefit in urban and rural planning from multiple perspectives,such as procedural protection,entity protection,judicial relief and so on.
