基因编辑婴儿视角的基因技术犯罪研究

On Gene Technology Crime from the Perspective of Gene Editing Infant Event

科学技术是把双刃剑,基因技术的发展给社会带来巨大福祉这是毋庸置疑的,但是不可避免地出现一系列关于伦理和法律问题。以在社会引发广泛讨论的基因编辑婴儿事件为例,针对基因研究过程中严重损害社会安全和秩序的行为,我国法律中并没有相应规定。当前,许多国家和地区对类似事件都有相应对策并在基因科技发展原则性与禁止性规则的综合作用下设置相关刑法责任制度,目的是为减少基因技术的社会负面效应和伦理的缺失。在我国刑事立法体系中,应当借鉴其他国家立法经验,结合我国实际,构建基因技术犯罪。

Science and technology is a double-edged sword.Genetic technology brings great benefits to the society but can not avoid the emergence of a series of ethical and legal issues.Based on gene editing infant event,there is no corresponding provision law for the serious harm of social security.At present,many countries and regions have corresponding measures for similar events and set up relevant criminal liability system under the comprehensive effect of the principle and prohibitive rules,with the purpose of reducing the negative social benefits.In the criminal legislation system of our country,we should draw lessons from the legislative experience of other countries and combine with our actual situation to prevent gene technology crime.
