矿产资源基本问题与法律制度研究

The Fundamental Issues of Mineral Resources and Legal System Research

文章在剖析研究矿产资源是什么、矿产资源勘查、矿产资源开采及矿产资源勘查开采与环境保护的关系等4个基本问题的基础上,对现有矿产资源相关法律关系及其问题、如何完善法律制度进行了探讨。研究认为,矿产资源具有自然属性和文化属性两重性,矿产资源自然属性赋予矿产资源使用价值、矿产勘查形成矿产资源价值;矿产资源与一般物不同,只有在开采程序开始后,才从描述性的物转为具象的实在物;矿产勘查是科学研究活动,其成果是知识产权;开采矿产资源是处分矿产资源的过程,应取得矿产资源所有权,国家作为矿产资源所有者收取矿产资源出让收益;矿产资源开发应与环境保护协调平衡,实行山、水、林、田、湖、草、矿、海生态环境综合治理。

Based on the analysis of four basic issues,such as mineral resources,mineral resources exploration,mineral resources exploitation,mineral resources exploration and environmental protection,the paper discusses the legal relationship and problems of existing mineral resources,and how to improve the law.The study believes that mineral resources have the duality of natural attributes and cultural attributes.The natural attributes of mineral resources give mineral resources use value and mineral exploration value to form mineral resources.Mineral resources are different from general materials,only after descriptive things are started after the mining process begins.Transformed into concrete objects;mineral exploration is a scientific research activity,the result of which is intellectual property rights;mining mineral resources is a process of disposing of mineral resources,and mineral resources should be acquired.The state as a mineral resource owner collects mineral resources to transfer income;mineral resources Development should be coordinated with environmental protection,and comprehensive management of mountain,water,forest,field,lake,grass,mine and sea ecological environment should be implemented.
