摘要
野生动物关键栖息地保护对于生物多样性保护具有重要价值。从立法保护的视角对美国濒危物种保护最新司法判例——"密西西比林蛙案"进行深入分析。在此基础上,结合当前国际社会濒危物种保护的理论和实践,我国野生动物保护应当建立系统的栖息地保护制度,加强环境影响评估及信息披露工作,构建生态保护优先的价值取向,处理好经济建设与生态保护的关系,为我国湿地立法提供参考。
Wildlife habitat protection is the key to the biodiversity conservation.From the perspective of legal protection,this paper analyzes on the application of the Endangered Species Act.Probing into the case of Mississippi Gopher Frog will be beneficial to solving this kind of problems in China.In connection with the theory and practice of the “Act of Wild Animals Protection”,it’s necessary to value the habitat protection,set up the strict system of the environmental impact assessment and give high priority to the ecological conservation in order to handle the relationship between economic construction and ecological protection and provide guidance for China's wetland protection legislation.
