善治视域下公民参与的实践逻辑

The Practice Logic of Citizen Participation from the Perspective of Good Governance

善治作为现代国家治理的一种理想模式已经确立为法治中国建设的战略方针并予以推进实施。善治模式关注的是公民与国家之间一种全新的合作关系,在此种治理理念下,国家还权于民、还政于民,公民成为国家治理的主体之一。善治要求以人民为中心实现人民主权,因而,吸纳公民参与国家治理乃是善治的基本要义,亦是现代法治的内在要求。公民参与以其约束权力任性的制度保障性功能来推动国家善治的实现,然而在国家治理实践中,公民参与的路径和方式仍存在一些机制性障碍,需要进一步完善公民参与的制度机制,以助力于国家善治的推行和实现。

As an ideal model of modern state governance, good governance has been established as a strategic policy for the construction of the rule of law in China and will be promoted and implemented. The good governance model focuses on a brand-new cooperative relationship between citizens and the state. Under this concept of governance, the state returns the power of government to the people, and citizens become one of the subjects of state governance. Good governance requires the people to be the center to realize the popular sovereignty. Therefore, absorbing citizens' participation in state governance is the basic essence of good governance and the inherent requirement of modern rule of law as well. Citizen participation promotes the realization of national good governance by its institutional guarantee function of restraining arbitrariness of power. However, in the practice of state governance, there are still some institutional obstacles in the path and method of citizen participation, and it is necessary to further improve the institutional mechanism of citizen participation to contribute to the implementation and realization of good governance in the country.
