国家监察体制改革对检察机关的影响与完善对策

The Influence and Its Improvement Countermeasure for Procuratorial Organs by the Reform of the State Supervision System

国家监察体制改革背景下,检察机关原先具有的职务犯罪侦查权转移到各级监察委。面对如此巨大的体制变动,检察机关应该顺应时代发展,并积极应对。本次监察体制改革对检察机关有着一定影响,包括了检察权需要重新进行定位、检察机关职权需要进行调整以及其他的延伸影响。针对这些影响,笔者认为有以下完善对策:一方面,检察权的定位应当理解成:基于公共利益为基础的,公诉权为主和诉讼监督权为辅的复合性权力;另一方面,检察机关应该转移职权重心,突破固有思维模式,突出公诉权主体地位,从多方面完善公诉权并且强化诉讼监督权。

Under the background of the reform of the state supervision system,the investigation power of duty crimes previously possessed by procuratorial organs has been transferred to the supervision committees at all levels.Faced with such huge changes in the system,procuratorial organs should conform to the development of the times and actively deal with them.This reform of the supervision system has a certain influence on the procuratorial organs,including the need to reposition the procuratorial power,the need to adjust the functions and powers of the procuratorial organs,and other extended influences.In view of these influences,we think that there are the following perfect countermeasures:on the one hand,the positioning of procuratorial power should be understood as:based on public interest,the compound power with the power of public prosecution as the main power and the power of litigation supervision as the auxiliary power;On the other hand,procuratorial organs should shift the focus of power,break through the inherent mode of thinking,highlight the main position of the power of public prosecution,perfect the power of public prosecution in many ways and strengthen the power of supervision of litigation.
