法治视野下高校权力清单制度探究

A Study of Higher Educational Institutions' System of List of Powers from the Perspective of Rule of Law

建立高校权力清单制度为高校治理能力和治理水平的提升提供制度保障,可以最大限度实现高校政治权力、行政权力、学术权力、民主权力的协调和相互制衡,达到限制和控制权力、完善高校内部治理体系的目的,形成现代大学制度。与政府权力清单相比,制定高校权力清单具有复杂性和现实困境。可以借鉴政府权力清单的模式,厘清高校权力的属性及边界,以相关法律法规为依据,进行系统的清理和审定,明确制定原则和程序,加强监督和问责等路径,实现高校权力清单制度法治化。

Establishing the system of list of powers in universities and colleges provides them with an institutional guarantee for the enhancement of their governance abilities and levels,ensuring a maxim coordination and mutual balance of their political, administrative, academic, and democratic powers. It will restrict and control powers,perfect inner governance system,and form a modern university system. Compared with the governmental list powers,the making of the university list has its complexity and difficulties. Realizing a law-based listing system can use the governmental list as an example,clarify the attributes and boundaries of powers,systematically sort and define the powers in accordance with the law and regulations,formulate clear principles and procedures,and strengthen ways of supervision and accountability.
