摘要
我国现行法律赋予电子商务平台经营者的公法审查义务,在一定程度上分担了行政机关对交易秩序与交易安全的保障功能,属于私法主体的第三方义务。从立法沿革上来看,我国电子商务平台经营者的公法审查义务经历了从网络信息内容的审查义务到网络交易行为的审查义务的转变,并拓展至包括安全保障义务在内的消费者权益保障义务。电子商务平台经营者的公法审查义务应当如何适用以及须履行到何种程度,法律规范上仍有进一步明确的空间,其具体化应当保持合理的界限,遵循法律保留原则、比例原则与类型化的监管原则。
China s law requires E-commerce platform operators to assume the public law obligation to review,which shares administrative agencies’function to guarantee transaction order and security to some extent.Such obligation is a third-party obligation of private law subjects.From the perspective of legislative evolution,the Chinese e-commerce platform operators’public law obligation to review has experienced the transition from the review obligation of e-commerce information to the review obligation of online transaction behaviors,and has extended to the obligation of consumer rights protection including security obligations.It is still necessary to further clarify how and to what extent should e-commerce platform operators perform the public law obligation of review.What s more,the specification of this obligation should be maintained in reasonable boundaries,which shall comply with the legal reservation principle,the proportion principle and the typed regulation principle.
