摘要
《粤港澳大湾区发展规划纲要》已经出台,粤港澳将携手打造国际一流湾区和世界级城市群。"一个国家、两种制度、三个关税区、四个核心城市",另加活力四射的珠三角。由于这种法域和政体的差异,粤港澳大湾区跨域性环境保护及治理的法律关系复杂,进一步深化合作中的法域差异导致的法制障碍不容忽视。因此,应以CEPA框架下所签署的双边协议中的环保合作条款为准则,在开放合作中相互借鉴吸纳包容,通过法制的力量与市场机制的有机结合创新制度,推进粤港澳大湾区跨域性生态环境治理的协调化、法治化。
"The development plan for GuangdongHong Kong-Macao Greater Bay Area"has been published. The Guangdong-Hong Kong-Macao Greater Bay Area is uniquely centered on"four cities, three customs territories and two different political systems." Governed by different political systems and hailing from different legal cultural backgrounds, the cities in the Guangdong-Hong Kong-Macao Greater Bay Area must cooperate by multidimensional mechanisms in the ecological environment governance. This paper focusing on "the Guangdong, Hong Kong and Macao Closer Economic Partnership Arrangement(CEPA)", Cities in the Pearl River Delta should reference from the experience of Hong Kong and Macao to build an habitable Bay Area by exploring possible reforms towards a modern legal administration following international practice under rule of law.
