环境司法专门化与专业化创新发展:2017-2018年度观察

Development towards Specialization and Professionalization of Environmental Judicature:Annual Observation of 2017—2018

本文在沿用《中国环境司法发展报告(2015-2017)》的基本思路、保持连续性的前提下,观察2017年7月至2018年12月的中国环境司法状况。环境司法继续平稳健康发展:一是专门化体系基本形成,体现为专门环境审判机构数量有所增长、环境审判队伍专业化建设得到加强、环境审判职能规范发展以及环境司法理念得到贯彻等方面。二是环境司法的专业化内涵不断拓展,体现为环境资源案件审判更加凸显"生态"特性,专业化审判规则不断完善,案件审理类型化、精细化进展明显。生态文明建设新时代司法的"绿色"脉络已清晰可见。展望未来,环境司法仍需在专门化道路上继续前进、更加充分发挥环境资源审判的独特功能,同时,也要在普通案件审理中落实"绿色发展"理念,为实现建设"美丽中国"目标提供有效的司法保障。

This report follows the basic ideas of China Environmental Judicature Development Report (2015-2017) and observes the situation of environmental judicature in China from July 2017 to December 2018. Environmental judicature continues to develop smoothly and healthily. First, the specialization system was basically formed, which was reflected in the increasing of specialized environmental judicial organization, the strengthening of the professionalization of environmental trial teams, the normalization of environmental trial function, and the implementation of environmental judicature concept. Second, the professional connotation of environmental judicature has been continuously expanded, which is reflected in the fact that there are more "ecological" characteristics in environmental trial, professional trial rules have been continuously improved, and the type and fi neness of the cases has progressed. The "green" context of the new era of ecological civilization construction is clearly visible. Looking to the future, environmental judicature should continue to advance on the specialization road and play the unique functions of environmental resource trials. At the same time, the concept of "green development" should be implemented in the ordinary trial to provide eff ective judicial guarantee for the goal of building a "beautiful China".
