顺应排污许可制度流变历程,《排污许可管理条例(草案征求意见稿)》的出台部分解决该领域立法乱象,并提升排污许可制度的法律位阶。该草案在宏观层面体现出排污许可制度定位由总量控制转向提高环境质量,在微观层面使排污许可制度责任体系更加完善。同时,该草案也体现出制度间衔接尚显不足、适用范围欠妥、义务类型过于粗糙的局限性,应当从明确排污许可性质、强化与相关法律制度衔接、加强排污许可程序的可操作性、细化责任规定类型等方面进行完善。

In line with the rheological process of the pollutant licensing system, the introduction of The Regulations on the Administration of Pollutant Permissions (Draft for Comments) partially clears out the legislative mess in this field as well as promotes the legal rank of the pollutant licensing system. At the macroscopic level, the draft shows that the position of pollutant licensing system is shifting from a total volume control to an environment quality improvement, while at the micro level, it makes the liability of pollutant licensing system more perfect. At the same time, the draft also shows some of the limitations, such as insufficient inter-system interfaces, imperfect application scopes, and undetailed obligati on types. The draft can be improved from the aspects of clarifying the nature of pollutant licensing, enhancing its connections with relevant legal systems, strengthening the maneuverability of pollutant licensing procedures, and refining the types of liability provisions.
