在建设现代化经济体系的过程中,现代经济体制的构建是具有统领地位的"核心问题",对其加强法治保障至为重要。为此,有必要考察我国改革开放和法治发展的历程,揭示"双手并用"的现代经济体制的形成及其基本内涵,以及对其加强法治保障的必要性;同时,应分析现代化经济体系各子体系的内在关联,说明现代经济体制对相关经济机制运作、经济理念落实的重要影响,以及将法治保障贯穿其中的重要价值;在此基础上,还应探讨影响"市场机制有效、微观主体有活力、宏观调控有度"的法律问题,从而明晰现代经济体制的法治保障的缺失以及完善相关制度的具体路径。只有在解决上述问题的过程中有效处理政府与市场、改革与法治、法治与发展的关系,才能更好地推进有中国特色的"法治理论"和"发展理论"的研究,促进经济与社会的良性运行和协调发展。

On this basis, we should also explore the legal issues that affect the effectiveness of market mechanism, the vitality of micro-subjects, and the degree of macro-control, so as to clarify the lack of legal protection of modern economic system and the specific path to improve the relevant system. Only by effectively dealing with the relationship between government and market, reform and rule of law, rule of law and development in the process of solving the above problems can we better promote the study of "rule of law theory" and "development theory" with Chinese characteristics and promote the sound operation and coordinated development of economy and society.
