摘要
在《劳动合同法》修改暂缓、共享经济等新兴业态蓬勃发展的背景下,我国执法部门与司法机关从"增量"与"存量"两条进路增加劳动力市场的灵活性。"增量"与"存量"并行的调整思路,虽然实现了增加劳动力市场灵活性的目标,但也促成了劳动关系与非劳动关系的就业"双轨制"。就业"双轨制"体现了制度与现实的碰撞,其存在具有一定的必然性,但也暗含诸多弊端与风险。解决上述问题需要从标准劳动关系"做减法"、非劳动关系"做加法"、非标准劳动关系"扩中间"三个方向同时发力。
Under the background of the revision of the Labor Contract Law being suspended and the booming development of sharing economy,the law enforcement agencies and the judiciary have increased the flexibility of the labor market from the ways of "increment" and "stock".It achieved the goal of increasing labor market flexibility,but it also promotes the dual system of employment of labor relations and non-labor relations.The "dual system" of employment embodies the collision between the legal system and the reality.Its existence has certain inevitability,but it also implies many drawbacks and risks.To solve the above problems,it is necessary to "do subtraction" from standard labor relations,"do addition" in non-labor relations,and "expanding the middle" of non-standards labor relations.
