网络舆论压力下的司法系统舆情应对研究

Research on Public Opinion Response of Judicial System under the Pressure of Internet Public Opinion

通过文本分析和深度访谈,认为网络舆论对案件审判的影响既意义深远,但实际影响程度又非常有限。网络舆论施加于审判的压力加速了中国司法公开的进程,促使司法系统加强了网络舆论应对和引导能力,更在微观层面促使法官更加小心谨慎办案,努力提高办案效率和质量。即便某些审判结果有舆情影响的因素,但判决结果也在自由裁量权范围之内。

Based on text analysis and in-depth interview, this paper finds that online public opinion exerts far-reaching influences on trial verdict, yet the actual impact is limited. The pressure from online public opinion accelerates the process of judicial transparency, drives the judicial system to enhance its capability of online public opinion response and guidance,urges the judges to verdict with more prudence, efficiency and higher quality at the micro level. Even though some verdicts have taken online public opinion into consideration, they are under the right of discretion.
