欧盟图书馆公共领域作品的数字化副本开放研究

Research on the Opening of Digital Copy of Public Domain Works in Europe Libraries

图书馆公共领域作品的数字化副本仍归属于公共领域是欧盟实现图书馆馆藏资源开放的一项法律层面上的原则。针对我国当前存在的图书馆限制公共领域作品数字化副本的自由使用现状,本文研究了欧盟数字化公共领域馆藏仍归属于公共领域的原则。从法理基础、发展历程、实施情况和实施障碍进行分析和论述,并结合实际提出对我国的启示:图书馆应从馆藏管理者向内容开放者转变;保障由公共资金资助数字化;图书馆应扩大公共领域作品数字副本的使用范围;建立统一的公共文化部门公共领域作品数字化副本开放平台。

Public domain works continue to be in the public domain once they have been digitized is an important legal principle for libraries to open their collection. The libraries in China have been set up many technical and legal restrictions to digitization of public domain content in these years. In order to solve this problem, this paper study the principle public domain works continue to be in the public domain once they have been digitized. Analyzing the basis of jurisprudence, development history, implementation and obstacles to implementation. Based on the results, this paper provides some suggestions to the practice in China: libraries in China should change their role from collection managers to the content publishers;guarantee the digitization is supported by public funding;expand the use of digital copies of works in the public domain;establish a unified platform for the publication of public domain works.
