The Belt and Road Initiative and International Economic Law Innovation:Ideas,Institutions and Paradigms

"一带一路"倡议下独具特色的国际经济法原则、规范、规则和决策程序,是对二战后西方主导的国际经济法的创新。在理念上,政府与市场有效结合的理念,是对自由市场主导理念的创新,合作共赢理念,是对利益交易理念的创新;在制度上,框架协议、软法文件及各种灵活多样的合作安排,是对硬法性质的国际经济条约制度形式的创新;"合作目标+合作领域+合作机制"及其"合作+伙伴+共赢"逻辑,是对"市场准入+权益保护+实施机制"及其"实力+市场+利益"逻辑的创新。这些创新实质上是对二战后西方主导的国际经济法的理论前提和制度预设的重大反思和改革,构成了一种范式性质的创新。"一带一路"倡议下的国际经济法范式与西方主导的国际经济法范式,是互补、互通、互动、互鉴的关系。

Compared with the International Economic Law(IEL)dominated by the United States and other Western countries after World War II,the unique principles,norms,rules and decision-making procedures of IEL under the"Belt and Road Initiative"are important innovations in IEL system.First,the idea of effective combination of government and market is very different from the idea of free market domination,while the idea of cooperation and win-win is very different from the idea of trade bargaining.Second,the framework agreements,soft law documents and various flexible arrangements are very different from traditional hard international economic treaties,while"cooperative goals+cooperation areas+cooperation mechanisms"and their"cooperation+partnership+win-win"logic are very different from"market access+equity protection+implementation mechanism"and its"power+market+interest"logic.These innovations are essentially significant reformation in the theoretical premise and institutional presuppositions of the IEL led by the United States and other Western countries after World War II,and constitute a paradigm innovation in IEL.The IEL paradigm under the"Belt and Road Initiative"and the IEL paradigm dominated by the West are complementary and more interactions between the two should be made.
