高等学校学术委员会与学位评定委员会的法律关系

On the Legal Relationship between the Academic Committee and the Academic Degree Evaluation Committee

高校学术委员会与学位评定委员会是中国现代大学治理的法定构成要素;学术委员会是高等学校内部最高学术机构,学位评定委员会则是兼具行政权力与学术权力的复合型机构。根据现行教育法律法规规定,学术委员会与学位评定委员会在各自权力轨道内履行学术或行政职责,有交叉亦有重叠。科学界定二者法律关系的根本在于有效辨识学术事务与行政事务的范围和本质。在实体法律关系中,学术委员会与学位评定委员会应奉行"学术与行政相对分离"原则;而在程序法律关系中,二者则应践行"相互配合、相互制约"规则。

The academic committee and the academic degree evaluation committee are the legal constituent elements of modern university governance in China. The academic committee is the highest academic institution of the university, but the academic degree evaluation committee is the institution which has both administrative power and academic power. According to the current education administrative laws and regulations, the two committees perform academic or administrative duties in their respective tracks, sometimes overlapping. In order to identify the legal relationship, the scope and essence of academic affairs or administrative affairs should be distinguished. The two committees should follow the separation principle of academic power and administrative power, and obey the rule of mutual cooperation and mutual restriction.
